Crackdowns on immigrants are all over the news. No need to panic. There is an orderly procedure to get you out of custody in Delaware.
For certain undocumented aliens, you can pay a bond (an amount to ensure your return) for release until your immigration hearing. ICE or a judge will set an amount of money to be held until the person returns to court.
The amount of money can be anywhere from $1,500 to $80,000 to get you out of jail. What do you do when you don't have that kind of cash?
Read on to learn more about immigration bail bonds in Delaware.
In general, if you are not a flight risk or a danger to the community, you can be released on bond. A few people may have mandatory custody. For example, a person with an outstanding deportation order or a criminal conviction.
Who Sets the Bond Amount?
ICE or an immigration judge sets the bond amount. The amount increases or decreases based on the person's employment status, ties to the U.S., immigration status, and criminal history.
The greater the risk that the person will not show up to their immigration hearing or fail to leave the country, the larger the bond amount. Bond money is returnable to the person who posted it if the conditions are met.
Types of Immigration Bonds
There are two types of immigration bonds. One to guarantee that a person completes the hearings process and one to ensure that a person leaves the country.
This type of bond is to ensure that the person released returns to face all of their immigration proceedings. It allows a person to continue their life, get legal help and make arrangements with their family. ICE typically sets the minimum bond at $1,500, although a judge might lower the amount.
This bond is a promise to voluntarily leave the country. A person must leave the country on their own, with their own funds, within a certain amount of time. The time allows a person to make arrangements for friends, family, and finances.
The minimum amount for this type of bond is $500. If the person does not leave by the time allowed, the bond is forfeited.
You have two choices for an immigration bail bond in Delaware. They are:
Surety Bond (Bail Bondsman)
You (or your family and friends) pay 15-20% of the total bond amount, and bond agent puts up the remaining money to ICE. The amount paid to the agent is non-refundable.
Any U.S. Citizen or permanent resident can deliver the full bond amount directly to ICE. The money is refunded once the person performs their duty (leave the country or attend all hearings.) Just be aware that the refund may take more than a year.

Just wanted to thank you and your colleges for your good work on bailing out my wife. I found you guys on the internet and had reservations about this whole process, with it being much more complicated than a regular bail bond. Your company does know what they are doing and your insurance company is properly liscensed to perform Immigration bonds as referenced on the Dept. of Justice's list of certified surety companies. Everyone was quick to take my calls, answer my questions and respond to my emails. Just wanted to say thanks and hope that everything concludes happily for me and my family.
I'm sorry it has taken so long to write to you, but life has been very hectic since we last spoke. I just wanted to let you know how much I appreciate all your help and support during the time I was going through the process of obtaining an Immigration Bond. This was all new to me and as you know, it was also very stressful for me. But you were very patient with me, and guided me through all the steps of the process to a successful conclusion. No matter how many times I called you, you always took the time to help me and I never felt rushed or pressured. I'm sure you give this wonderful service to all your clients and I hope they appreciate you as much as I do. I hope to never have the need for this type of service again, but I will never forget your kindness and empathy. Many, many "Thanks" and "Good Luck" to you in all you do.
