A Complete Guide to Immigration Bonds South Carolina

It's no secret that the Trump administration is particularly hostile toward undocumented immigrants. U.S. Immigration and Customs Enforcement (ICE) has released its numbers for their Enforcement and Removal Operations under this administration in 2018. Over 158,000 administrative arrests were made and 256,085 undocumented immigrants were deported.

What do these numbers mean? According to ICE, bookings were up 22.5%, and removals were up 13%. With numbers like these, it is important to be aware of what to do in the event you or your loved ones are detained by ICE.

Is your friend or loved one being held and facing deportation? Don't panic. Read on to learn everything you need to know about immigration bail bonds in South Carolina.

What Is an Immigration Bail Bond?

An immigration bail bond is used to get people out of ICE detention centers. It is a three-party contract between Homeland Security; the Surety, the bonding company; the Agent, a friend or family member who obtains the bond; and the Principal, the defendant in detention.

The bondsman and the agent guarantee that the defendant will appear for any and all Notice to Appear dates once they are released on bond. The Agent agrees to make sure that the defendant shows up for his or her Notice to Appear dates and agrees to pay the full cost of the bond if the defendant does not show up.

In exchange for the bail bond, the Agent pays a percentage of the full bond amount to the bonding company.

The Two Types of Immigration Bail Bond South Carolina

Delivery Bond

A delivery bond is used to release an undocumented immigrant from ICE custody back to their home in the United States. In order to qualify for this type of bond, the immigrant must have received an arrest warrant as well as a notice of custody conditions.

Voluntary Departure Bond

voluntary departure bond is used when the defendant no longer plans to stay in the United States. This means your loved one cannot stay with you in the US and is looked at as a last resort.

When you obtain this type of bond, it means that you are guaranteeing that the defendant in custody will return to their home country within a certain period of time and at their own expense. They will not face a formal removal order and thus can avoid expensive fines and, in most cases, permanent bars to re-admission to the US.

How Much Does It Cost?

There's no set bond amount. The immigration judge is in charge of setting the bond amount based on a variety of factors. These include the defendant's criminal history and family connections.

Bonds are also more expensive if the judge thinks the defendant is a flight risk. As a guideline, delivery bonds generally range from $1,500 to over $10,000. Departure bonds are much less expensive and are usually less than $1,000.

What Our Clients Say About Us

Just wanted to thank you and your colleges for your good work on bailing out my wife. I found you guys on the internet and had reservations about this whole process, with it being much more complicated than a regular bail bond. Your company does know what they are doing and your insurance company is properly liscensed to perform Immigration bonds as referenced on the Dept. of Justice's list of certified surety companies. Everyone was quick to take my calls, answer my questions and respond to my emails. Just wanted to say thanks and hope that everything concludes happily for me and my family.
