Immigration bail bonds are monetary deposits that guarantee that the person to whom a release is granted will do what the judge requires them to do.
The money is not returned in the event that the conditions are not met by the former detainee.
Immigration Bail Bonds in Pennsylvania
The judge will determine the amount of the bail bond. The typical minimum amount is $1500.
In Pennsylvania, the average amount for an immigration bail bond is between $5000 and $15000. Before ICE releases the detained individual, the bond has to be paid in the full amount.
A bond paid early in the day will, in most cases, mean the release of the detainee that same day.
There is no specified time period in which the bond must be paid unless the judge rules otherwise.
Anyone can pay the bond with these requirements:
- proof of current address
- 2 forms of identification, one with a photo
- a valid social security number or tax ID number
- a valid phone number
- name, DOB, country of origin, and A-number (Alien Registration Number) of the detainee
- address and phone number of the place where the former detainee will reside while the case is ongoing
Two Types of Bonds
There are two types of immigration bonds to consider.
1. Delivery Bonds
A delivery bond allows the detainee to be released on a temporary basis once it's paid.
The amount of the bond correlates with the severity of the crime of which the illegal immigrant is accused.
The detainee is required to show up for court hearings and forfeits the bail amount paid if he or she is a no-show.
Requirements for a Delivery Bond
- An arrest warrant
- A custody conditions notice from ICE
2. Voluntary Departure Bonds
If the detainee agrees to leave the country voluntarily, in a certain amount of time and at his own expense, a voluntary departure bond is granted.
Once confirmed that the person has left the country, the bond paid will be refunded.
Failure to leave the country within the time frame specified will result in the forfeiture of the money.
The person will be detained and charged again.
Paying the Bond
You can pay for the bonds at an ICE office that accepts bond payments with money orders or certified bank checks.
Another option is to use a licensed bondsmman who deals in immigration bonds. Always do your research and find a reputable bond company.
