What Are Immigration Bonds New Mexico?

Immigration bail bonds in  the state of New Mexico are, in essence, similar to a regular bail bond or "surety bond."

When someone gets arrested, posting bail is one way to get them out of jail. Bail is a set amount of money a judge deems an appropriate amount for the accused to pay for their release.

Because the amount is usually high, a friend or family member enlists the service of a bail bondsman.

A bondsman may ask for collateral to secure the bond. They also charge 10% which isn't refundable.

But, this bond is the insurance that after their release, the accused will show up at their court date.

Immigration bail bonds work along the same lines. There are two types of immigration bail bonds:

Delivery bond - ICE or an immigration judge determines the eligibility of a detained immigrant to seek a delivery bond. ICE will give the detainee an arrest warrant and a notice of custody conditions.

This bond is the insurance that they'll show up to their immigration hearing. 

They're able to be with their families and consult or hire an immigration attorney. This type of bond is almost like a regular surety bond.

Voluntary departure bond - Sometimes, detainees have the option to leave the country voluntarily. They must do this at their own expense by a set date. 

This bond is fully-refundable if they leave the U.S. by the date on the bond. If they don't, ICE keeps the entirety of the bond. 

How Much Do They Cost?

Either ICE or a judge sets the bond amount. For a delivery bond, the price starts around $1,500. It can increase to $10,000 or more, depending on the results of a risk assessment. 

A voluntary departure bond is much lower. Usually, the minimum is set at $500. 

It's important to note that it can take up to a year for the person who posted the bond to receive their money. They will only get refunded if the detainee attends all court proceedings. 

The No-Bond Detention Law

While this sounds pretty cut and dry, there is a caveat. 

In 2016, New Mexico Legislature passed a law that gave judges the authority to deny bail to "proven dangerous defendants." It doesn't matter how much the detained immigrant can pay to buy a bail bond. 

Part of that law also stipulates that a detainee who isn't dangerous nor a flight risk can't be held in jail only because they can't pay for a bail bond. 

What Should You Do?

If ICE detained a loved one, there are two calls you should make.

The first is to an immigration bond agent. The second is to an immigration attorney.
