While these bonds always differed from other bail bonds, judges are now setting larger fees than ever.

The minimum bond according to the law was $1,500. Even in the past 20 years, it was not uncommon for judges to set bonds well over that number - sometimes as high as $7,500. Judges in Texas were told to set the bond according to "common sense rules."

In the last year, those numbers have grown to include excesses of $10,000 or even bonds as high as $25,000. Increasingly more bonds requests get denied altogether.

What Are Immigration Bail Bonds?

Immigration bail bonds are bonds used in cases when a person is arrested and detained by the U.S. Immigration and Customers Enforcement (ICE). Once processed, ICE applies one of two options: release on personal recognizance or require an immigration bail bond.

There are two types of immigration bail bonds in Texas.

The first is a delivery bond. These bonds are set by ICE or immigration judges under the promise that the detainee will attend all set hearings.

Alternatively, the judge or ICE may issue a voluntary departure bond. In this case, the bond gets repaid once the detainee lawfully and officially leaves the country at their own expense.

How Do I Pay for the Bond?

Unlike traditional bonds, immigration bonds come at a higher cost to the friends and family of the detainee.

If you have the full amount set by the judge or ICE, then you can pay everything upfront. The bond gets refunded once the detainee successfully attends all the scheduled hearings in court.

Families may also work with immigration bond agents to achieve a surety bond. In general, agents charge up to 20 percent of the bond amount as payment. Although you receive a refund once the detainee completes their obligations, the money provided as the bond fee remains with the agent.

Do You Qualify for an Immigration Bail Bond?

ICE and immigration courts assign bonds at their discretion. However, the detainee receiving the bond must also meet several qualifications.

First, they must have a clean record and must not have convicted of a crime noted by ICE or the Department of Homeland Security.

Second, they need a permanent physical residence where they will live and can be easily reached by the government.

Finally, immigration bonds are not available to those arrested at a port of entry.
