5 Things to Know About Immigration Bonds Mississippi

You find out a loved one is in jail, it can be devastating. Finding out they're in immigration custody is worse. Finding out they're in immigration custody in Mississippi is catastrophic.

Immigration bail bonds in Mississippi have become a lucrative business in and of itself, with one company pulling in $2.6 million in just a year and a half.

Immigration bonds in Mississippi are broken down into four main groups, which bond agents can assist you with. If a loved one finds themselves in ICE custody, here's what you need to know to how bonds work in Mississippi.

Immigration Bail Bond Mississippi

Bail bonds in Mississippi work a little differently than most other states, because of the requirement of bondsmen reporting every bond. Every bond is logged with a list of details including a bond number, the name of the defendant, their charges, bond amount, and much more.

With some exceptions, Mississippi is one of the only states with an up-to-date log tracking each and every bond in all counties and municipalities.

How Bail Is Set

Like everywhere else, bail is set by a judge. The amount set is determined based on a number of factors, the major one being whether the person is a flight risk or a risk to their community.

Bail bonds in Mississippi will charge 10 percent or 15 percent of the entire bond or $100, whichever is greater; a difference in percentage is determined on the seriousness of your crime.

How Much Is Bail

The smallest amount a judge is legally allowed to set bail is $1,500. For immigrants seeking asylum, a bond can go as high as $25,000. Because of how high bonds tend to be for immigrants, most can't afford to post the funds

Delivery Bonds

A delivery bond is the most common type of bond. Aliens who post a delivery bond are set for a secure release from custody but must meet with immigration officials. The process for meeting an official for a hearing or interview can be lengthy, lasting several years at most.

Failure to appear means paying the full amount of the delivery bond. Learn more about how to pay for immigration bonds here.

There are several guidelines for which a delivery bond is set as per Form I-352.

Supervision Bond

With this being a lengthy process due to delays, aliens may get an order of supervision. This only occurs if the originating country of the alien refuses to take them back.

The Department of Homeland Security will grant a supervision bond to the immigrant, granting temporary leave from jail, granted the immigrant will not breach the instructions given to them. If they do, they will be forced to pay the full amount of the bond penalty.

Public Charge Bond

A public charge bond grants the immigrant freedom, though they cannot accept public assistance. This rule is enforced until they are either deported, naturalized, or they die. Failure to comply will result in the immigrant having to pay the bond in full.

Voluntary Departure Bond

When an immigrant wants to enter into the United States, they can apply for a voluntary departure bond. Essentially, this means the immigrant can stay in the country for a specified period of time and will voluntarily leave. Once jailed or deported, the immigrant loses their bond.

With some exceptions, the immigration bail bonds in Mississippi is rather similar everywhere else in the country. If you find yourself in need of bail bondman, apply for our free consultation.

What Our Clients Say About Us

Just wanted to thank you and your colleges for your good work on bailing out my wife. I found you guys on the internet and had reservations about this whole process, with it being much more complicated than a regular bail bond. Your company does know what they are doing and your insurance company is properly liscensed to perform Immigration bonds as referenced on the Dept. of Justice's list of certified surety companies. Everyone was quick to take my calls, answer my questions and respond to my emails. Just wanted to say thanks and hope that everything concludes happily for me and my family.
